These Terms & Conditions (“Terms”) govern your use of I-Journey, operated by I-Journey Inc. (“I-Journey”, “we”, “us”). By creating an account or using the platform, you agree to be bound by them. If you do not agree, do not use the platform.

1. Peer-to-Peer Transactions & Disputes

I-Journey acts solely as a platform for users to share, book, and purchase itineraries or travel experiences. We are not a party to any agreements or transactions between users. Users are solely responsible for their interactions and any disputes arising between them. I-Journey may, at its discretion, assist in dispute resolution but is not obligated to do so and assumes no liability for user-to-user disputes.

2. Third-Party Service Providers & APIs

I-Journey integrates with third-party service providers, such as travel booking APIs, for certain functionalities. We do not guarantee, endorse, or warrant any third-party content or services and are not responsible for any errors, omissions, or issues arising from their use. Users are solely responsible for complying with third-party terms and conditions.

3. User-Generated Content & Itinerary Sales

Users are solely responsible for the content and itineraries they create, share, or sell through the platform. I-Journey does not guarantee the accuracy, legality, or quality of any user-generated content or itineraries.

4. Payment Processing & Taxes

All payments are processed through third-party payment processors. I-Journey is not responsible for any errors, delays, or issues arising from payment processing. Users are responsible for reporting and paying any applicable taxes on income received through the platform.

5. Limitation of Liability

I-Journey is not responsible for any loss, injury, or damage arising from user interactions, bookings, or transactions conducted via the platform.

6. Governing Law & Jurisdiction

The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the laws of Ontario, Canada. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Ontario, Canada.

7. Insurance

I-Journey does not provide insurance for users, trips, or any activities booked through the platform. Users are responsible for obtaining their own insurance coverage as needed.

8. Refunds & Cancellations

Refunds and cancellations for bookings or purchases, including user-generated itineraries, are subject to the policies of the applicable provider or content creator. I-Journey is not responsible for processing or guaranteeing refunds.

9. Privacy & Data Protection

Your use of the platform is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information.

10. Changes to Services

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without notice.

11. Eligibility & Your Account

You must be at least 16 years old to create an account. You agree to provide accurate registration information and to keep it current. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account, and you agree to notify us promptly of any unauthorised use. You may close your account at any time from your account settings.

12. Acceptable Use

You agree not to use the platform to post, share, or sell content that:

• infringes the copyright, trademark, or other rights of any person;
• is unlawful, fraudulent, deliberately misleading, or misrepresents a trip you are offering;
• harasses, threatens, defames, or is hateful toward any person or group;
• is sexually explicit, or depicts or encourages violence or illegal activity;
• contains malware, or is spam or unsolicited promotional material;
• impersonates another person, or falsely claims affiliation with any business or organisation;
• discloses another person’s private information without their consent.

You also agree not to scrape, copy, or bulk-download content from the platform, interfere with its operation or security, or attempt to access accounts or data that are not yours.

You can report content that breaches these Terms by contacting us. We may remove content or restrict accounts that we reasonably believe breach this section.

13. Ownership of Your Content

You keep ownership of the itineraries, photos, and other content you create. Publishing content does not transfer ownership to us.

By publishing content on the platform, you grant I-Journey a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting and display purposes, and publicly display that content in order to operate and promote the platform. This licence exists so that we can show your itineraries on the site, in our newsletters, on our social channels, and in app listings. It ends when you delete the content or close your account, except for copies retained in backups and for content others have already saved or purchased under the terms below.

You confirm that you own or have the rights to the content you publish, including any photographs, and that it does not infringe anyone else’s rights.

Where the platform allows another user to save and adapt a published itinerary, you grant that user a personal, non-exclusive licence to do so for their own travel planning and to republish an adapted version as a free itinerary. An itinerary derived from a purchased exclusive itinerary may never be republished or sold as an exclusive itinerary.

14. Creators, Exclusive Itineraries & Payouts

Users may publish free itineraries or exclusive itineraries that other users pay to unlock. The unlock fee is calculated from the length of the trip and is displayed before purchase. Unless we state otherwise at the time of purchase, revenue from exclusive itinerary unlocks is shared 75% to the creator and 25% to I-Journey.

Creator payouts are made through our payment processor, and you may be required to complete that processor’s identity and tax verification before receiving funds. You are responsible for any taxes owed on your earnings. We may withhold or reverse a payout where a transaction is refunded, charged back, or reasonably suspected to be fraudulent, or where the associated content breaches these Terms.

Once purchased, access to an exclusive itinerary is permanent for the purchaser. Verified Travel Creator status is granted at our discretion following review of an application, and may be withdrawn if these Terms are breached.

We may change fees, the revenue share, and payout arrangements. Where a change affects creators, we will give reasonable notice before it takes effect, and it will not apply to purchases already made.

15. Suspension & Termination

We may suspend or terminate your account, or remove content, if you breach these Terms, if your conduct creates risk or legal exposure for us or other users, or if required by law. Where circumstances reasonably allow, we will tell you why.

If your account is closed or terminated, your published itineraries will be removed from public view, except that users who have already purchased an exclusive itinerary retain their access to it. Earnings properly due to you at that point remain payable, subject to the withholding provisions above.

Sections covering content ownership, limitation of liability, governing law, and any payment obligations already incurred survive the closure of your account.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the date at the top of this page, and where changes are material we will provide additional notice. Your continued use of the platform after a revised version takes effect constitutes acceptance of it.
